Board of Health Regulations
The following Rules and Regulations have been adopted by the Hanson Board of Health

The following regulations were voted and passed by the Hanson Board of Health on Apri117, 2001 effective immediately.
        (1) Septic systems consisting of a single cesspool shall be upgraded at the time a property is transferred to conform to 310 CMR 15.00, the State Environmental Code, Title V, Minimum Requirements for the Subsurface Disposal of Sanitary Sewage. Cesspools with an overflow or leaching pit may continue to be used but will require an observation hole to determine ground water.

Purpose: To avoid contamination of ground and surface water by Substandard on-site sewage disposal systems. Substandard systems present a serious threat to drinking water thus negatively affecting public health. This contamination also poses a threat to designated wetlands affecting the environment and public health. This regulation shall be strictly enforced during the building permit application process.

        (2) To adopt the State Sanitary Code (Minimum Standards for Human Habitation) and the State Environmental Code, Title 5, (Minimum Requirements for the Subsurface Disposal of Sanitary Sewage) as Hanson Board of Health "local" regulations with the following penalties for violations:
                (a) Non-Criminal Disposition -Whoever violates any provision of these rules and regulations may, in the discretion of the Health Agent and/or Members of the Board of Health be penalized by a non-criminal complaint pursuant to the provisions of MGL Chapter 40, Section 21 D. For the purpose of this provision the penalty to apply in the event of a violation shall be as follows: A written warning for the first offense with a $25 fee; $50 for the second offense; $100 for the third offense; and $200 for the fourth and each subsequent offense. Each day on which a violation exists shall be deemed to be a separate offense.
                (b) Criminal Complaint -Whoever violates any provision of these rules and regulations may be penalized by indictment or on complaint brought in the District Court. Except as may otherwise be provided by law, and as the district court may see fit to
impose, the maximum penalty for any violation of these provisions shall be $300 for each offense.
        (3) Potable wells requiring a filter and backwash (flushing) must be of the following: (a) Flow type (not time) for regeneration. (b) Potassium chloride as the flushing agent. (c) New construction with a potable well will require a 2000 gallon septic tank. If a 1500 gallon septic tank is used, an alternative vessel for the backwash operation must be installed.

Effective February 25, 1998 for all septic repairs and new septic system installations:
        When the proposed final grade is to be different from an existing grade, a final grading inspection by the design engineer will be required after the sewage system has been backfilled and before the as-built plan is submitted to the Board of Health office. Final grading spot elevations and contours must be shown on the as-built plan. Certificates of Compliance will be issued after the as-built plan is received.

Effective January 16, 200 1:
        An observation hole will be required to establish ground water for all Title 5 septic system inspections with cesspools and/or leaching pits where no records are on file in the Board of Health office.
