Joint Meeting with Water Commissioners
January 22, 2003
Present: Robert Forte, Stephanie McSweeney and Peter Jones.
9:01 p.m. Acting Chairman Stephanie McSweeney called the meeting to order.
The Board of Selectmen were asked by the Water Commissioners during their meeting if the Board of Selectmen would support a request for legal counsel to counsel them on their rights to appeal the 40B decision of the Board of Appeals relating to Dunham Farms Development. The Water Commissioners did not want to use Kopelman & Paige, since they had worked for the ZBA. The Selectmen met to consider this request, as time was of the essence and the Board of Selectmen did not have another posted meeting until February 4, 2003. The Water Commissioners wanted legal counsel to advise them on what options they had regarding waived hookup fees and other issues.
MOTION by Jones, second by Forte to allow the Water Commissioners, at their expense, to use special counsel, at a comparable rate to what Kopelman & Paige charges, for the purpose of determining their legal options regarding 40B process, specifically relating to Dunham Farms. Voted 3 – 0.
MOTION by Jones, second by Forte to adjourn. Voted 3 – 0.
