Can I subdivide my property?

Some Requirements for Subdividing Property:

  • Which Zoning District is the property located ?
  • Is the project located on a public way accepted by the Town of Hanson or a private way ? (Private Ways are not owned by the town).
  • What are the requirements of the zoning district ? (i.e. frontage, land area, setbacks, access)
  • Does the site contain any resource areas that require filing and approval with the Conservation Commission and DEP ? (i.e. Wetlands, Riverfront, Natural Heritage, Flood Zones)
  • Do any of the resource areas located on site prevent it from becoming a buildable lot ? (wetland area vs. upland area required)
  • Will the property be subdivided under an Approval Not Required Plan (ANR, also known as a Form A plan) or a Subdivision ? (Each has its own requirements, Forms, Fees and processes)
  • Is the property capable of sustaining a Soil Absorption System ? (i.e. septic system)
  • Has a percolation test been performed to determine if soil conditions will sustsain a Soil Absorption System ? (Percolation testing must be witnessed by the Board of Health).
  • Will the site be subject to the Stormwater Regulations and require a drainage analysis and stormwater control structures ?
  • Is the site located in a regulatory flood zone ?
  • Will the project require filing with MESA or MEPA ?
  • Will the amount of disturbance trigger the filing of an MS-4 permit with the Town and/or with the EPA  ? (Projects distrubing more than one acre of land require filing with both).
